In 2016, the Frank R. Lautenberg Chemical Safety for the 21st Century Act brough a significant update to the 1976 EPA Toxic Substances Control Act (TSCA). This amendment provided the EPA the ability to regulate chemical substances in the workplace. This presentation will provide an overview of the EPA’s TSCA efforts on worker safety and health and a summary of mandatory risk evaluations of existing chemicals deemed by the EPA to pose unreasonable risk with a focus on vulnerable populations. In addition to these EPA risk assessment, other chemicals of emerging concern include per- and polyfluoroalkyl substances, or PFAS, with new local, state, and federal regulations. Commercial real estate managers and property owners should be aware of the potential impact of significant fines, penalties, and legal liability associated with emerging contaminants.

Learning Objectives:

  • Participants will gain a basic understanding of the 2016 EPA amendments to TSCA
  • Provide an overview of current regulatory action for chemicals of emerging concern
  • Discuss potential challenges commercial real estate managers and property owners
